It’s SUPERMAN. A valuable new addition to BIMCO’s suite of ship management agreements, the Supervision Contract for Ship Construction, code named SUPERMAN, is itself currently under construction by a team of industry experts. The Supervision Contract will provide third party shipmanagers with a standard agreement to govern their duties and obligations when acting in a supervisory capacity on behalf of a ship owner during construction or conversion projects.

SUPERMAN will be a stripped down version of SHIPMAN 2009, taking advantage of the familiarity that the “look and feel” of SHIPMAN provides. At its core will be the key clauses of SHIPMAN dealing with issues such as manager’s authority, liabilities and termination – all adapted to suit this particular service. Like SHIPMAN, the Supervision Contract will provide users with a range of optional services to suit the needs of users. Options include site supervision, guarantee claims handling, plan approval and technical specification review.

A first drafting session took place in London on 8 September and work is due to continue on 24 November. The drafting team, led by Ajay Hazari of Anglo Eastern, involves shipmanagement experts from shipping companies Graig and d’Amico, assisted by ITIC and law firm Curtis Davis Garrard.

The new Supervision Contract is due for completion and publication in November 2015.
