2006年12月8日,IMO正式同意将MSC.216(82)加入SOLAS公约修正案。该修正案强制规定了所有类型船舶的专用海水压载舱和散货船的双舷侧处所内的保护涂层在建造中应符合的性能标准。

该PSPC公约适用于建造合同订立于2008年7月一日之后或龙骨铺设于2009年1月1日之后或交付日于2012年7月1日之后的船舶。

现在距离7月1日之前交船的大限还有不到一个月的时间,但是根据工信部的数据显示,目前国内船厂仍有359条船舶不能满足PSPC之要求。这些船舶要么选择在7月1日前勉强交付,要么就只能选择去寻求一些其他的帮助了。

这里就要感谢仁慈的IMO在2007年就已经在MSC.1/Circ.1247“关于不可预见的延期交船的统一解释”中为现在这些焦头烂额的船厂和船东铺下了后路。

现在船厂和船东就可以用不可预见的延期交船这一理由为他们不能在7月1日前交付的不符合PSPC标准的船舶进行抗辩了。他们可以以此来向船舶的未来待注册船旗国申请PSPC豁免。然而考量船舶是否属于受到不可预见的延期交船影响是具体案例具体分析的,因此船厂和船东应该尽可能的向船旗国提供详尽合理的导致交船日期不可预见延期的证据。

全球的金融危机和黯淡的航运市场就是一个很好的理由。其导致的船东延期付款或弃船都会阻碍船舶的正常建造。

船东和船厂需要做的就是以此为理由向船旗国管理当局递交一张PSPC豁免申请信,同时还应递交可以证明船舶交付不可预见的延期的证明材料,如签订日期在2008年7月1日之前的建造合同和原船东的弃船信或仲裁,判决通知等。

在得到豁免后,一条不符合PSPC标准的船舶就基本已经可以合法的在2012年7月1日后交付了。但是对于那些由船厂注册的原船东弃船船舶只能获得“搁置”状态船舶证书,知道其找到新的买家和合格的管理公司。

此外,在这类船舶交付时,船级社还会在该船的货船安全建造证书的交船日期上填上如下脚注:“船旗国已同意该船为由于不可预见因素而导致的延期交付船舶,以此该船可免除于SOLAS关于PSPC之相关规定要求。”

最后,船旗国欢迎申请人自愿提供他们的授权组织出具的其船舶涂层和PSPC规定的差距分析报告。(By paris zhang)

On 8 December 2006, IMO adopted amendments to SOLAS by resolution MSC. 216(82) which mandate compliance with the new IMO "Performance Standard for Protective Coatings for dedicated seawater ballast tanks in all types of ships and  double-side skin spaces of bulk carriers".

Compliance with the IMO PSPC regulation is required for ships of which the building contract is placed on or after 1 July 2008; or, in the absence of a building contract, the keels of which are laid on or after 1 January 2009, or the delivery of which is on or after 1 July 2012.

With only one month to go before the deadline, as many as 359 vessels will not meet the PSPC criteria according to statistics from Ministry of Industry and Information Technology. Either they will be pushed to delivery before 1 July 2012, or it is love and other drugs will be needed.

Thanks to the merciful IMO, in 2007 they’ve already created such an elixir for today’s sufferer in its MSC.1/Circ.1247—UNIFIED INTERPRETATION OF“UNFORESEEN DELAY IN DELIVERY OF SHIPS”.

Now the ship owners and shipyards can declare an unforeseen delay in delivery of ships against its delivery date which will be on or after 1 July 2012. On that ground, they can apply for a PSPC exemption letter from their vessels future flag state administrations. However the consideration of unforeseen delay in delivery of ships by the administration is on a case by case basis, so the builder and the owner have to provide the administration with specific and reasonable proofs of what unforeseen circumstances are beyond the control.

The worldwide financial crisis and gloom shipping market is a good reason. Under that circumstance the buyer may have suspended the payment or cancelled the contract which leads to the interruption and delay of production.

Then all they have to do is to send an application letter to the flag state administration along with all the supporting documents of the unforeseen delay, i.e. ship building contract dated prior to 1 July 2008 and letter of cancellation from original buyer or arbitration notice or court notice.

Now it’s almost there to get a non PSPC compliance vessel to be lawfully delivered on or after 1 July 2012 with an exemption. But for those abandoned ships registered by shipyard themselves, they can be only registered under a Lay-up status until taken over by a future buyer and a management company.

Furthermore, upon delivery of each ship the ships’ class society shall be instructed to annotate the delivery date on the Cargo Ship Safety Construction Certificate with a footnote to indicate that the ship is accepted by the Administration under the unforeseen delay in delivery provisions of the interpretation of SOLAS regulation II-1/3-2 contained in MSC.1/Circ.1247 and is therefore not required to comply with the requirements of SOLAS regulation II-1/3-2.

In the end, a volunteered gap analysis of vessel’s coating and PSPC from RO is always welcomed.(By paris zhang)
