3.445 The ‘‘time lost waiting for berth’’ at clause 6(c) of earlier versions of the Gencon form has been replaced by the following at lines 109–119:

If the loading/discharging berth is not available on the Vessel’s arrival at or off the port of loading/ discharging, the Vessel shall be entitled to give notice of readiness within ordinary office hours on arrival there, whether in free pratique or not, whether customs cleared or not. Laytime or time on demurrage shall then count as if she were in berth and in all respects ready for loading/discharging provided that the Master warrants that she is in fact ready in all respects. Time used in moving from the place of waiting to the loading/discharging berth shall not count as laytime. If, after inspection, the Vessel is found not to be ready to load/discharge time lost after the discovery thereof until the Vessel is again ready to load/discharge shall not count as laytime.

3.445在金康租船合同早期版本第6(c)条款中的‘等泊损失时间’,已被1994版金康格式第109-119行的文字代替了,如下:

如果,在船舶抵达装/卸货港口或者港外时,而没有空闲可用的泊位,则船舶有权在抵达后的正常办公时间内递交准备就绪通知书,无论检疫与否,无论清关与否。如果船长保证船舶事实上在所有各个方面均准备就绪,如同她已靠泊并在各方面做好装/卸货物准备一样,装卸时间或滞期时间就开始计算。从等泊位置移到装/卸泊位的所使用的时间不应计入装卸时间。如果,经检验发现船舶并未准备就绪,因而,从发现之时起直到船舶再次准备就绪这段时间不得计入装卸时间。

3.446 What is said at paras 3.443 and 3.444 above presumably applies to the first part of the above about where notice of readiness can be given if a berth is not available. The word used is ‘‘available’’ not ‘‘accessible’’, an important distinction. The use of this phrase presumably confines its application to non-availability due to congestion and excludes a situation where the berth is not reachable due to weather.

3.446在上文第3.443段和第3.444段所讲的原则,推测起来也适用于上段第一部分关于无空闲泊位递交通知书的情况。使用‘空闲可用的’这一词与‘自由可进入的’一词是有着重要的区别。这一短语的作用大概是把它限定在因港口拥挤导致的泊位不可用性,而排除因天气原因导致不能抵达泊位的情形。

3.447 Although this clause uses permissive language in that the vessel ‘‘shall be entitled’’, if the preceding conditions are met, to give notice of readiness, the remainder of the provision proceeds on the basis that it has been tendered.

3.447虽然这一条款使用的是自由式的语言,其中,如果前面的条件满足的话,船舶‘必须是有权去’递交准备就绪通知书,并且,在后一部分条文也是依据通知书已经递交的基础上进行(计算装卸时间)的。

3.448 If the charter is a berth charter, and there is no other provision allowing notice to be presented before arrival in berth, then if notice cannot be given on arrival because the berth is available, albeit it cannot be reached, the provision provides no mechanism for notice to be given once the berth becomes reachable, even if by then it may no longer be available.

3.448如果是一份泊位租船合同,而且这也没有其他的规定允许船舶在到达泊位之前递交通知书,那么,如果船舶不能在抵达时递交通知书,而泊位虽然空闲可用,但却不能进入靠泊的话,该条款并不没有提供解决机制以使泊位一旦可以靠泊就可递交通知书,即使随后泊位可能变得不再可用时。

3.449 Under this provision, time once commenced counts as if the vessel is in berth and, therefore, under this new formula, only exceptions which apply if the vessel was actually in berth will apply. Shifting time does not count as laytime but time on demurrage continues to run.

3.449根据这一条款,时间一旦开始计算,就好像船舶就在泊位上一样看待,因此,在新的计算原则下,只有在船舶实际靠泊的时候才能适用的除外条款,这时也适用于(等待时间)。虽然移泊时间不计入装卸时间,但,船舶滞期的话,时间就会持续计算而没有中断。

3.450 The final part of this provision appears to give effect to what was decided in The Linardos and The Jay Ganesh.
